Powell, PE Director of Public Works & Utilities City Engineer 903-935-4489 City of Marshall PO Box 698 Marshall, TX 75671 From: Mikes Corner Shoe Store [mailto:mikeslusser@ymail.com] Sent: Wednesday, July 10, 2024 2:38 PM To: Eric Powell Cc: Terrell Smith Subject: 300 N Washington Eric, Per our discussion a couple of months ago, please forward me the engineering plans for our block specifically, and any changes implemented after construction discoveries. I will be happy to pay any fees necessary to obtain these plans. Although my daughter did say you agreed to send a copy, we haven’t received them. If you are unable to provide the plans, please let me know and I will move forward with an open records request. As you are aware, the front foundation of my building is slowly failing. The rain has created holes in the front (under the cracked cement from construction) and they continue to get larger as we get more rain. The water is flowing thru these holes when it rains, and it is not unusual to see over 3ft of standing water in my basement, which obviously effects my foundation. Continued negligence and lack of preventative flooding measures by the contractor is causing severe deterioration of my building. I am sure you are aware, but this building is one of the oldest buildings in Marshall, and the First Mortuary in the State of Texas. Any help you can give us to mitigate future flooding damages would really be appreciated. Simply sand bagging the area would help the problem. Furthermore, a few months ago we discussed the large clay drain line that runs down the side of my building (not related to the current construction). During this time, you were able to use the camera to check the status of the drain. It is my understanding the drain is not collapsed, however, there are roots that have grown thru the drain line in places. Please confirm your findings by replying that you agree this is what the camera found (for my records), or your interpretation of the drain line condition. If the City has a plan on when they expect to fix this side drain line, that information would also be appreciated. Lastly, I would like to address safety concerns. The entire area in front of my building is unsafe and filled with hazardous debris. There is a large deep hole (drain line access) that is not safe and there have been times when nothing is even covering it. This area over the drain line is a hazard and a major safety concern that should be at the minimum taped off with “caution tape.” I really worry that one of my elderly customers will be a victim of these unsafe conditions. Any help you can give us would be appreciated. If you are unable to help, please let me know, so I can move forward accordingly. Thank you for your help and I look forward to your response.
